Law 13/2013, which was adopted on 27 September 2013 and is aimed at attracting foreign investors, introduced for the first time the possibility of obtaining a new type of visa and residence permit in Spain for foreign investors outside the EU, also known as "GOLDEN VISA". This type of visa is aimed at investors who invest in properties or make other significant investments in our country.

This type of visa is aimed at investors who invest in properties or make other significant investments in our country.

Requirements to apply for a residence permit in Spain for investors:

  • Investors who want to get a Golden Visa will need to make an investment of more than €500,000 net (excluding taxes and expenses) in real estate assets on Spanish territory. This investment can be done in an asset or by adding up several assets.

Main advantages of obtaining a residence permit in Spain.

  • Authorisation to live and work anywhere in Spain, with a renewable validity of 2 years and which can become a permanent residence by obtaining the Spanish citizenship.
  • These advantages may also be transferred to the spouse and children under 18 years of age or those of legal age who cannot support themselves and have not constituted their own household, as well as parents who are dependent. They may all apply for it jointly, simultaneously or successively together with the investor.
  • There is no need for a minimum stay.
  • Right to travel to Spain and all the countries of the Schengen area without any visa.
    • The countries pertaining to the Schengen area are as follows: Germany, Austria, Belgium, Denmark, Estonia, Finland, France, Greece, Hungary, Iceland, Italy, Latvia, Lithuania, Czech Republic, Liechtenstein, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Slovenia, Slovakia, Sweden and Switzerland.
  • They shall be considered non-residents as to the payment of taxes in Spain.
  • Obtaining a residence permit and visa undergo a faster procedure: 10 days for the visa and 20 days for the residence permit.

Other requirements to be met by investors

  • To be of legal age.
  • To not have entered or to have never stayed illegally in Spanish territory.
  • To prove that they have the financial resources for the individual and for the family members during their residence period in Spain.
  • To enter Spanish territory at least once during the term of the visa.
  • To hold a valid investor visa or to be within the period of 90 calendar days after its maturity.
  • To have hired a health insurance with an entity authorised in Spain.
  • To not have any criminal record in Spain or in the country or countries, where the applicant has lived for the past 5 years.
  • To have not been rejected by any country featuring a valid agreement with Spain in this regard.
